The prosecutor's appeal is dismissed.
Reasons
The prosecutor appealed from the lower court’s sentence (two years of suspended execution, 80 hours of community service, and 40 hours of lecture to comply with the law in one year and six months of imprisonment).
However, in full view of various sentencing conditions as shown in the records and arguments of this case, including the fact that there is no particular change in the sentencing conditions compared with the original judgment, and that the defendant was the first offender and the victims agreed to do so, the sentencing of the original judgment is not recognized as unfair.
Therefore, the prosecutor's appeal is dismissed.
