2. The costs of lawsuit shall be borne by the Plaintiff.

가. 피고 공단은 2010. 11.경 네오트랜스 주식회사(이하 ‘네오트랜스’라고만 한다)와 공동으로 경기철도 주식회사(이하 ‘경기철도’라고만 한다)가 시행하는 B 복선전철 민간투자사업(건설기간 2011. 2.부터∽2016. 2.까지 60개월, 운영기간 개통 후 30년)의 사업관리{토목, 궤도, 건축 분야 사업관리(PM), 무인운전 등 시스템 엔지니어링 분야 사업관리(SE)}에 참여할 것을 계획하였다.

B. The Defendant Corporation decided to establish T/F teams under the Construction Headquarters for the above business management, and around January 3, 201, the following “B public announcement of the selection of human resources for business management (hereinafter “instant public announcement”) was made.”

Support Requirements: The head of the team shall be at least the head of the team, the team members shall be at least the head of the team, the working conditions when they are converted to the contract positions after retirement of the Corporation: 60 months from the contract date, the amount of wages equal to those before retirement of the remuneration level, employment as contract workers after retirement of the Corporation, and employment as B business management T/F team before transition of contract positions.

C. From January 3, 2011 to January 6, 2011, Defendant Corporation received the application from the applicants, and then selected three persons including the Plaintiff as the team members. As of February 16, 2011, Defendant Corporation issued a personnel order ordering work to the construction headquarters B business management T/F team.

From the time of the issuance of personnel management, the Plaintiff performed duties such as concluding joint supply and demand agreements with Netrophs, and working negotiations and preparation of draft agreements for concluding a PM/ES service agreement with the Gyeonggi Railroad.

On May 4, 2011, the defendant Corporation entered into a joint supply and demand agreement with the business management that sets forth the scope of business management, allocation of roles, etc., and entered into a MF/ES service agreement with the Gyeonggi Railroad on August 23, 2011.

E. The Plaintiff is at the Defendant Corporation on June 30, 201, according to the public notice on the selection of human resources of the instant case.
