The judgment of the court below is reversed.
Defendant shall be punished by a fine of KRW 700,000.
The above fine shall not be paid by the defendant.
1. The summary of the grounds for appeal is as follows: (a) in the police investigation, the defendant showed that he was able to install a game machine in front of the defendant's convenience store, and stated that he was able to do so; (b) the defendant was able to install a game machine in front of his convenience store; and (c) the defendant was able to request E to install a game machine; and (d) the defendant had already been able to give cash in the already installed game machine; and (e) the defendant has installed a game machine in front of 20 days of her convenience store; (b) in light of the fact that the defendant was aware that the game machine of this case was not classified, the court below found the defendant not guilty of the facts charged of this case.
2. No person who outlines the facts charged shall provide game products for distribution or use, the rating classification of which has not been obtained from the Game Rating Committee;
Nevertheless, from Jun. 2012 to Jul. 10, 2012, E, from Jun. 2, 2012, to Jun. 2012, 198, at the “K convenience store” located in theJ of the Chuncheon City of the operation of Defendant, E, by dividing the two game machine of “prinkers”, which was not classified by the Game Rating Board, into 5:5, divided Defendant C and the profits from Defendant C, and provided them for the use of many and unspecified customers.
As a result, Defendant C provided game products not classified by the Game Rating Board in collusion with Defendant C for use.
3. The lower court determined as follows: (a) He installed the “mincers” and “legal pumps” game machine without being classified at the convenience store in Chuncheon City, including the convenience store operated by Defendant C; and (b) the three types of game machine are different in appearance and game method.
