Punishment of the crime
1. The Defendant is a person engaging in driving a vehicle BSM-7 vehicle.
On September 26, 2014, the Defendant driving the above vehicle at around 02:35, and driving the three-lane road in front of the Chungcheongnam-gu, Chungcheongnam-gu, Chungcheongnam-gu, Daejeon at a speed that would make it impossible to identify the speed of the road by using the three-lane road in front of the Chungcheongnam-gu, Chungcheongnam-gu, Daejeon.
At the same time, the Defendant was stopping after D SP car driven by C, which was stopped for the signal atmosphere prior to the same direction, and thus, there was a duty of care to prevent accidents in advance by accurately manipulating the steering and brake system to the person engaged in the driving business.
Nevertheless, the defendant neglected this and received the rear part of the motor vehicle operated by the defendant due to the negligence by removing a light which is taking the operation system of the motor vehicle.
Ultimately, the Defendant, by the above occupational negligence, destroyed the Switzerland car to use the repair cost of KRW 508,616, such as the exchange of the above Switzerland car, and escaped without immediately stopping the Switzerland and taking necessary measures.
2. No person who violates the Guarantee of Automobile Accident Compensation Act shall operate any motor vehicle on a road which is not covered by mandatory insurance;
The Defendant driven the BSM 7 car without mandatory insurance at the time and place specified in paragraph (1).
3. Where a transferee of an automobile violating the Automobile Management Act intends to transfer it to a third party, he shall make an application for the registration of transfer of ownership in his name to the competent authority before transferring it to a third party.
On 2013, the Defendant acquired BS-7 automobiles that have been transferred under the name of E from a person who was unable to know his/her name via the Internet, and as described in paragraph (1).
