Punishment of the crime
1. Defendant A is a person who works as the head of the branch office of the South Korean Electric Power Corporation (hereinafter “D”) from December 29, 2015 to December 29, 2016, and has overall control over the affairs of the said branch, such as the installation and maintenance of electric lines, and the management of information on the capacity of solar power stations, while working as the head of the branch office of the South Korean Military Power Corporation (hereinafter “D”). Defendant B is a person who operates the said branch office, a company that constructs, operates, and sells solar power plants.
Officers and employees of the Korea Electric Power Corporation shall be deemed public officials in the application of Articles 129 through 132 of the Criminal Act in accordance with the Act on the Management of Public Institutions.
2. Defendant A’s crime;
A. The Defendant violated the Act on the Aggravated Punishment, etc. of Specific Crimes (Bribery) at the office of the head of the above C branch office located in F around March 1, 2016, at the above C branch office located in F, the Defendant transferred from G unions the right to construct eight solar power plants to H ( = 99W x 8) in the south H., with the consent of “W to secure and change the line capacity so that it can be constructed.” Upon receiving the foregoing request from the said B, the Defendant is required to construct one solar power plant at low price for the convenience of the above construction process, and the supply price is KRW 300,000 in the Defendant’s wife’s name (including value-added 30,000,000,000,000 won) and KRW 304,000,000,000,000 won and KRW 304,000,000,000,000,000 won and KRW 30,34,04,000.
B The cost of construction that is normally paid in relation to the above eight power plants is KRW 250 million (20 million (construction cost) and KRW 10 million (system connection cost).
