A defendant shall be punished by imprisonment for five years.
Seized 0.42g (No. 1) and 97g (No. 2) shall be confiscated, respectively.
Punishment of the crime
The Defendant is not a person handling narcotics as an illegal aliens of the nationality of Thailand, and the Defendant is prohibited from dealing with psychotropic drugs, such as Mebacopon (hereinafter referred to as “mancopon”), and “YABA” containing philopon ingredients.
1. The Defendant, along with a person who was named in Thailand’s name (one name B; hereinafter “B”), intended to import phiphones into the Republic of Korea. B sent approximately 1.38 g of phiphones to the Republic of Korea, indicating “Dopocheon-si C” and “the addressee” as “D,” and the said postal item arrived at the Incheon State’s service port on June 17, 2018, as F, around 05:46.
Accordingly, the defendant imported philophones in collusion with B.
2. The Defendant of the amba and ambaphones imported with B to import the amba and ambaphones into the Republic of Korea. B sent the place to receive amba and ambaphones 99, and approximately 0.47g ambaphones to international express shipment boxes as “I(J)” and then sent the place to receive amba and ambaphones by international registered mail (e-mail number K) around May 1, 2019.
Accordingly, the defendant imported clocks and philophones in collusion with B.
3. A foreigner who violates the Immigration Control Act may sojourn in the Republic of Korea within the limits of his/her sojourn status and period of sojourn.
Nevertheless, around December 28, 2017, the Defendant entered the Republic of Korea through Incheon Airport as a qualification for visa exemption, and stayed in the Republic of Korea until May 15, 2019 without departure even after the period of stay expires as of March 28, 2018.
