(소멸시효연장을위한)공사대금반환
1. The defendant shall pay to the plaintiff KRW 101,40,000 as well as 5% per annum from December 11, 2006 to November 8, 2007.
1. On November 8, 2007, the Plaintiff filed a lawsuit against the Defendant for the return of the construction cost, which was sentenced to the judgment that “the Defendant shall pay to the Plaintiff 101,400,000 won and the amount equivalent to 5% per annum from December 11, 2006 to November 8, 2007, and 20% per annum from the next day to the day of full payment,” and the judgment became final and conclusive around that time.
The lawsuit of this case shall be filed to extend the prescription period according to multi-oms when the extinctive prescription of the above judgment bond expires.
2. Article 208 (3) 1 of the Civil Procedure Act of the applicable provisions of Acts;
3. Amendment of the Regulations on Special Cases Concerning Legal Interest Rates under the main sentence of Article 3 (1) of the Act on Special Cases Concerning Promotion, etc. of Legal Proceedings to the partial dismissed part, 15% from October 1, 2015 shall apply.
