마약류관리에관한법률위반(향정)
A defendant shall be punished by imprisonment for three years.
3,300,000 won shall be additionally collected from the defendant.
The above additional charges are imposed on the defendant.
Punishment of the crime
Despite the fact that the Defendant is not a narcotics handler, the Defendant treated the Mept Ampha (hereinafter referred to as “philopon”) of a local mental medicine as follows:
1. On January 19, 2017, the Defendant: (a) decided to purchase a penphone from “C (DID E)” that he/she searched and became aware of a penphone from “former text,” which is the Internet search portal site; (b) transferred the part-on phone amounting to “C” at around 19:00 on January 19, 2017 from G located in “C” to “C”; and (c) purchased the part-on phone amounting to approximately 600,000 won on the part of “C”, and then received the part-on phone amounting to approximately 1g on the part of “C”.
2. Import of philophones.
A. The Defendant, as indicated in paragraph 1, conspired with “C” with the knowledge that he/she delivers a phiphones abroad, intended to import the phiphones, and then remitted the c to “C” a bitcos equivalent to KRW 5 million limited to the c, “C” concealed approximately 8g of the phiphones into an international special transport cargo, and then delivered them to the place designated by the Defendant on January 23, 2017, and the said phiphones arrive at the Incheon International Airport (H).
On January 24, 2017, the Defendant received the international special consignment which was concealed through an international stacking company at the 2238 Busan Terminal as the center of the Geum-gu, Busan., the Defendant received from the 2038 Busan.
B. The Defendant conspired to import “C” and philophones by the foregoing method, remitted to “C” 600,000 won, and “C” concealed approximately 1g of philophones into an international express shipment, and delivered them to the place designated by the Defendant, and delivered the said philophones to the air (H) for the departure from the international air port of the Republic of Korea on February 21, 2017.
On February 22, 2017, the Defendant received the international special consignment, where the said penphone was concealed through the international contact provider in the above G around 19:00.
Accordingly, the defendant imported philophones over twice.
3. The Defendant, who sells philophones, is named I on January 17, 2017 and January 24, 2017.
