A. The Plaintiff’s claim for indemnity against C entered into each guarantee insurance contract (hereinafter “each guarantee insurance contract of this case”) with E Co., Ltd. as indicated below, and C jointly and severally guaranteed the indemnity liability to be borne by E in the event that the Plaintiff pays insurance money to the insured due to the occurrence of each of the respective guarantee insurance contracts of this case.

On July 27, 1991, the insured amount between the insured on July 27, 1991, F (State) from July 27, 1991 to January 25, 1996, KRW 360,000,000 on July 27, 2191, or KRW 40,000 on each guarantee insurance contract of this case from July 27, 1991 to January 25, 1995; the Plaintiff paid insurance money to the insured of each guarantee insurance contract of this case on September 8, 1992; the Plaintiff paid the insurance money to the insured of each guarantee insurance contract of this case on August 20, 2019 to the Plaintiff; the sum of the amount of the claim for reimbursement as of August 20, 2019 to the Plaintiff = KRW 957,53,500,00 ( principal of the guaranteed insurance contract of 194,205, 2039, 37139).37

On November 5, 1997, the Plaintiff filed a lawsuit seeking the payment of indemnity amount with the Gwangju District Court 97Kadan48322, and was sentenced to a full winning judgment. ② On September 28, 2007, the Plaintiff filed a lawsuit seeking the payment of indemnity amount by the Gwangju District Court 2007Kadan43677 and was sentenced to a full winning judgment. ③ The Plaintiff filed a payment order with the Gwangju District Court 2017Ka5358 and received the payment order on August 9, 2017.

B. On April 10, 1989, the provisional registration C in the name of the Defendant for the real estate owned by C completed the registration of ownership transfer on April 24, 1989 with respect to each real estate indicated in the separate sheet on the grounds of sale and purchase (hereinafter “each of the instant real estate”).

C On September 18, 1995, as described in Section 1 of this case on the ground of trade reservation, C shall make a provisional registration of the right to claim ownership transfer (hereinafter referred to as “provisional registration of this case”) to the Defendant with respect to each real estate of this case.
