A. The Plaintiff and the Defendant’s PC sales contract (1) leased the Seoul Songpa-gu D 2-story store from C in KRW 20,000,000, and operated the EPC (hereinafter “the instant PC store”).

(2) On September 1, 201, the Plaintiff: (a) included all facilities, such as computers and monitors, with respect to the instant PC, and (b) entered into a sales contract with the Defendant on September 1, 201, with a deposit of KRW 64,920,000, including deposit of KRW 20,000; and (c) a down payment of KRW 8,000,000 on the date of the contract; and (c) a deposit of KRW 17,080,000 on the installment for the purchase price, such as computers and monitors of the Plaintiff (the name of the Plaintiff would be the fatherF); and (d) the remainder shall be paid on September 16, 201; and (5) the Defendant and the lessor enter into a sales contract with the terms that sell the remainder by entering into a lease contract again.

The defendant paid 8,000,000 won to the plaintiff on the same day.

(3) 그 뒤 피고가 위 잔금 지급일보다 일찍 입주하게 되자, 원고와 피고는 2011. 9. 9.경 작성일을 2011. 9. 1.로 소급하여, ① 매매대금은 임대차보증금 20,000,000원을 포함한 82,000,000원으로 하되, ② 계약금 8,000,000원은 2011. 9. 1. 지급한 계약금으로 갈음하고, ③ 원고의 주식회사 골든브릿지캐피탈에 대한 할부금 채무를 16,840,000원으로 계산하여 피고가 승계하며, ④ 임대차보증금 20,000,000원은 2011. 9. 15. 피고와 임대인 사이에 임대차계약을 체결하면서 정산하기로 하고, ⑤ 원고가 사용한 전기료 등 550,000원은 원고가 피고에게 지급하기로 하며, ⑥ 나머지 잔금 36,600,000원(≒ 매매대금 82,000,000원 - 계약금 8,000,000원 - 할부금 채무 승계 16,840,000원 - 임대차보증금 20,000,000원 - 전기료 등 550,000원)은 2011. 9. 9. 지급하기로 일부 내용을 변경하였다.
