The prosecutor's appeal is dismissed.
1. The summary of the grounds for appeal is unreasonable because the punishment of the lower court (including a fine of 500,00 won and completion of a sexual assault treatment program 40 hours) is too uneased.
2. The prosecutor's assertion is without merit, in full view of all the facts pertaining to the judgment, the defendant's deep reflects on the first offense, the extent of the defendant's indecent act is not much serious, the defendant suffers from the first degree of brain-disease disorder, the defendant has no particular economic ability, the defendant's age, occupation, and other facts pertaining to the sentencing specified in the records and arguments of this case.
3. Therefore, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the grounds that the appeal is without merit. It is so decided as per Disposition.
