1. The Plaintiff among the distribution schedule prepared by the said court on December 20, 2018 in the distribution schedule D of the Suwon District Court Ansan Branch D.
1. Basic facts
A. The Plaintiff is operating a job placement office with a trade name called G in Gangnam-gu Seoul E building F.
B. The Plaintiff requested human resources supply from H Co., Ltd. (hereinafter “H”) from May 2017 to August 2017, and introduced and supplied human resources at the construction site of the new building located in Gangnam-gu Seoul Metropolitan Government I from May 2017 to August 2017.
C. The Plaintiff filed a lawsuit against H with the Plaintiff seeking the payment of KRW 5,764,450 of work personnel wage and its delay damages (Seoul Central District Court 2017Dada468845). Accordingly, the court rendered a favorable judgment of the Plaintiff on April 6, 2018, and the said judgment became final and conclusive around that time.
On the other hand, Defendant B claimed against H that “the above Defendant operated the Manpower Office in Suwon City with the trade name of J, and that H supplied human resources from July 2017 to September 2017 at H’s request, but H did not pay KRW 105,221,001 for human resources, and that H applied for a payment order seeking payment of the said money (U.S. District Court 2017 tea2449), and H did not object to the payment order on November 1, 2017, and the said payment order became final and conclusive on November 16, 2017.
E. The Plaintiff: (a) obtained a collection and seizure order (Seoul Central District Court 2018TTT10139) against H’s claim against H Co., Ltd.; (b) obtained a collection and seizure order (Seoul Central District Court 2018TTA) against KRW 20,000,000 among the above claims; and (c) obtained a collection and seizure order against KRW 600,000 among the above claims (a collection and seizure order for KRW 20,000,000 among the above claims (a collection and seizure order for KRW 20,000,000) from the above claims; and (d) served on L Co., Ltd., respectively.
F. L Co., Ltd. deposited KRW 5,778,787 as Suwon District Court’s Ansan Branch 2018Hun-2123.
G. On December 20, 2018, the said court in the instant case of the distribution procedure for the said deposit.
