1. The Defendant’s KRW 23,109,200 as well as the Plaintiff’s annual rate from September 1, 2014 to May 31, 2016, and the following.
1. The plaintiff claiming indication is a person who runs a wholesale and retail business of food materials in the trade name of "C", and the defendant is a person who operates a restaurant business in the trade name of "D".
The Plaintiff sold food materials to the Defendant from March to August 31, 2012 to August 31, 2014, but did not receive KRW 23,109,200 out of the price.
Therefore, the defendant is obligated to pay to the plaintiff 23,109,200 won and the amount of delay damages at each rate of 6% per annum under the Commercial Act from September 1, 2014 to the delivery date of a copy of the complaint of this case from September 1, 2014, and 15% per annum under the Act on Special Cases concerning Expedition, etc. of Legal Proceedings from the next day to the day of full payment.
