1. The Defendant stated the Plaintiffs in each corresponding column of “total amount of claim” listed in the separate sheet No. 2 attached hereto, and each of them on December 2012.
1. Basic facts
A. The Future Savings Bank, Inc. (hereinafter “BS Savings Bank”) is a savings bank with the aim of engaging in credit installment savings business, receipt of deposits and installment savings, and loan business. Around May 2012, it was designated as an insolvent financial institution by the Financial Services Commission and suspended its business. On April 30, 2013, it was declared bankrupt by the Seoul Central District Court 2013Hahap54.
B. The defendant was appointed as the trustee in bankruptcy of the future savings bank.
The plaintiffs are employees who worked in the future savings bank.
C. The future savings bank operated a fingerprinting system that electronically records the working hours and retirement hours of employees. Based on the working hours and retirement hours recorded in the fingerprinting system, the employee in charge prepared a daily report on the status of commuting records for each employee, based on which the employee prepared a monthly report on the status of commuting management for each employee and managed it with the approval of the head of the management support center.
Future Savings Bank has paid regular bonuses, heavy meals, and physical training expenses to its employees in accordance with the following salary regulations and welfare regulations:
The definitions of terms used in the provisions of this Article of the Benefit Regulations shall be as follows:
1. The term "wages" means the principal salary, allowances, and bonuses;
3. The term “ bonuses” means regular bonuses and special bonuses;
3-1. The term "ordinary wages" means the principal salary, position allowances, financial allowances, responsible person allowances, computer allowances, technical allowances, research and study allowances, and receipt and disbursement allowances;
4. For the purpose of the calculation on the daily basis of benefits, regardless of the number of days of the relevant month, the benefits of the relevant month shall be calculated by 1/30, but any amount below the won shall be rounded off;
Article 7 (Calculation of Benefit) (1) Wages shall be paid on a daily basis as of the date of issuance in all cases, such as recruitment, retirement, reinstatement, leave of absence, elevation, promotion, demotion, change of position, reduction of salary, and any other cases.
Article 35 Payment of bonuses (2) Regular bonuses shall be paid within the limit of 600% of the annual salary.
