2. The costs of lawsuit shall be borne by the Plaintiff.

A. The Defendant is an educational foundation that establishes and operates a D University under its jurisdiction. B. Around the end of 2015, the D University published a summary of the 2016-year recruitment process to recruit transfer students (a bachelor’s general course). Of the content of the announcement, the “I.D. Study” stated that “Special Admissions to Medical Science shall be incorporated into the first and the second grade, but the number of students may be extended for a certain period of time as required for completing the course of the player course, on the ground that they must complete the course of the first grade (a.e., medical department).”

C. The Plaintiff was granted the first-year curriculum of dental colleges by having passed a bachelor enrollment examination with the department of dental medicine after reporting the above recruitment outline.

On March 8, 2016, the Plaintiff filed an application for taking lectures on dental art and the second-year subjects, which are not the subjects of dental medicine and the first-year subjects, according to the instruction of guidance professors.

E. The provisions pertaining to the instant case, including school regulations of the D University, are as follows:

[Enforcement Rule of the School Regulations of D University (amended on August 27, 2012; hereinafter “Enforcement Rule of the Defendant’s School Regulations”) Article 3 (Application for Taking Courses) (4) Students shall be subject to instruction by teaching faculty prior to applying for taking lectures in relation to the number of subjects for each semester.

(8) The course designated as an athlete shall be completed first of all the players.

Article 7 (Completion of Courses) (8) The credits of major courses in a pharmaceutical department shall be in accordance with the curriculum of the department, and the designated major basis and the compulsory major subject shall be completed without fail, and the remaining credits shall be completed in the selection of major subjects.

The compulsory major subject and the basic major subject shall be completed before graduation.
