피고인들은 공동하여 2017. 7. 4. 00:10 경 위 E 식당에서, 피고인 A이 식대를 계산하면서 피해자에게 “ 짱 개 새끼, 2,000원 너 가져 ”라고 말한 것으로 피해자와 시비가 되어, 피고인 A은 피해자의 얼굴 부위를 손바닥으로 2회 때리고, 주먹으로 가슴 부위를 3회 때리고, 계속하여 화장실에 다녀온 피고인 B는 피고인 A에 합세하여 피해자의 머리 부위를 손바닥으로 2회 때린 후 피해자의 양팔을 잡아 뒤로 꺾고, 피고인 A은 양팔이 꺽인 피해자의 얼굴 부위를 손으로 1회 때리고 발로 배 및 다리 부위를 각 1회 찼다.
