A. The Defendant is the owner of the building on the ground outside B of Chuncheon City (hereinafter “instant building”), and the Nonparty C is the owner of the D ground building adjacent to the instant building (hereinafter “Adjoining housing”).

B. The instant building owned by the Defendant consists of a single-story house and a single-story storage, which is the main building of the third floor size and its affiliated building, and the Defendant, around October 2, 2008, leased to E a part of the instant building as KRW 400,000 per the rent-on monthly.

C. On June 22, 2001, C entered into a fire insurance contract with the Plaintiff as follows with respect to the entirety of adjacent housing and interior household tools:

The total amount of KRW 114,450,916, and the total amount of KRW 35,549,000,000,000,000,000,000 for household effects insurance (insurance ceiling) consisting of neighboring houses and interiors of the subject-matter of insurance for 15 years from June 22, 2001 to June 22, 2016.

D. On March 3, 2015, around 11:34, 2015, a fire occurred in a warehouse attached inside a single-story house among the instant building owned by the Defendant, and as a result, a small-scale living room, etc. of neighboring houses was partially burned and a household-to-house was dissolved.

On April 9, 2015, the Plaintiff calculated the amount of damages suffered by C due to the instant fire, based on the result of the damage evaluation by the damage adjuster, and paid the Plaintiff KRW 22,350,379 insurance money to C for neighboring housing and household housing (=Building 19,016,968 KRW 3,33,411).

F. Meanwhile, the Chuncheon Police Station and the Chuncheon Fire Prevention Station are presumed to be a warehouse attached to the inside of the single-story house among the buildings in this case, but the single-story house among the buildings in this case consists of a space partitioned into a room, kitchen, and warehouse. The inside of the kitchen was burned only part of the ceiling, and the inside of the kitchen was seriously burned, and the storage was the highest in the case of the warehouse.
