A. The Plaintiff entered into a construction contract (hereinafter “instant construction contract”) with the Defendant in early 2014, which newly constructs multi-household C Dong (hereinafter “instant building”) in Gyeonggi-gun C (hereinafter “instant construction contract”) with the Defendant, the construction cost of KRW 581,00,000,000 (However, without the Plaintiff’s license for construction business, the Plaintiff entered into a contract with the contractor as the Han River Construction Industry Co., Ltd., and the subcontractor as the Plaintiff.

(2) The instant building was approved on August 18, 2014, and the registration of ownership preservation was completed in the Defendant’s name on August 27, 2014.

B. The Plaintiff and the Defendant settled the instant construction cost of KRW 62,00,000 on September 2014, 2014, on the grounds that the construction cost was increased by KRW 81,069,00 as follows, compared to the time of the instant construction contract, compared to the instant construction contract, the instant construction cost was settled as KRW 662,00,00, and the Defendant’s unpaid construction cost was KRW 175,00,000.
