The defendant is a person who produces and sells X-ray with the trade name of D Farmwon in Nam-gu, Nam-gu, Seoul Metropolitan City.

No person shall indicate or advertise that foods, etc. have efficacy or effect in preventing and treating diseases, or that such foods, etc. are likely to cause mistake or confusion as medicine or health functional foods, with regard to the name, manufacturing method, quality, and nutrition labelling.

Nevertheless, on July 27, 2016, in order to promote the sale of X-ray, the Defendant sold the above X-ray 2 Park 300,000 won of food at the above deaf source. The Defendant sent the above king 1,3130,00 won of the facts charged in total over 1.20 times from around that time to March 30, 2017, stating “exploitation and reproduction, reduction, inter-party function improvement, physical strength enhancement, blood pipe cleaning, grheat, strengthening of exempted power, grheatization, grheatization, and skin carbon force maintenance” in the former part, while selling the above X-2 Park 30,000 won of the facts charged in total, which is a 3,130,000 won of the facts charged in the charge, but it is apparent that this is a clerical error, so the Defendant sent the above 2780,000 won of the evidence to correct it (the record).

As a result, the Defendant indicated or advertised that foods might have efficacy or effect in preventing and treating diseases, or that foods could be mistaken for drugs or health functional foods.
