매매대금반환
1. The Plaintiff, Defendant A, Defendant A, Defendant B, Defendant B, Defendant C, Defendant C, Defendant C, KRW 69,00,000, and Defendant D, KRW 96,400,00.
1. Facts of recognition;
A. On November 8, 2011, the Plaintiff entered into a sales contract with Defendant A to purchase the purchase price of KRW 970,000,000 (each payment of KRW 97,000,000,000,000,000 upon contract) prior to E from the said Defendant. On April 30, 201, the Plaintiff paid the down payment of KRW 97,000,000 to the said Defendant on the date of the contract. (2) On November 8, 2011, the Plaintiff entered into a sales contract with the said Defendant to purchase the purchase price of KRW 413,60,00,00 from the said Defendant, and to purchase the remainder of KRW 622,00 from the said Defendant on the date of the contract to purchase the down payment of KRW 413,60,00 (the down payment,00,000,000 on April 30, 201).
3) On November 8, 2011, the Plaintiff entered into a sales contract with Defendant C to purchase the purchase price of KRW 1,380,000,000 (each of the down payment of KRW 69,000,000 at the time of the contract, and the remainder of KRW 1,311,00,000 on April 30, 2012) from the said Defendant. On November 8, 2011, the Plaintiff paid the down payment of KRW 69,00,00 to Defendant C. On the following day, the Plaintiff entered into a sales contract with Defendant D to purchase KRW 1,593 square meters from the said Defendant, and paid the remainder of KRW 964,00,00 (the down payment of KRW 96,40,000,000 on April 30, 200, the remainder of KRW 60,000 on April 6, 200, respectively).
B. Each of the instant sales contracts, which include the special terms and conditions, that “this sales contract is a conditional contract for construction permit (large-type sales facility) and the remainder period may be extended when the permission is delayed from the management agency (hereinafter “instant special terms and conditions”).
C. On February 20, 2012, the Plaintiff entered into each of the instant sales contracts and constructed a large sales facility with a size of 2, 4, 995 square meters and a total floor area of 23,132 square meters on the ground on the ground of the said purchased land, which is the competent administrative agency, the Plaintiff.
