(2) Article 208(3)1 (a) of the Civil Procedure Act provides for the statutory interest rate of Article 3(1) of the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings for Part of Reasons for Payment (a judgment without the presentation of a written reply) is amended on September 25, 2015 and enforced on October 1, 2015, the rate of delay damages from the date of delivery of a copy of a complaint to the date of delivery of a copy of the complaint is recognized to be only 15% per annum. Thus, it is recognized that only damages for delay calculated at the rate of 19% per annum, which is higher than this case’s delay interest rate, shall be dismissed.
