The defendant shall pay to the plaintiff KRW 36,867,625 and KRW 4,014,709 among them, per annum from February 26, 2020 to the date of full payment.
A medical corporation D (hereinafter “the medical corporation of this case”) has subscribed to the Plaintiff’s credit card company’s credit card company member and agreed to pay damages for delay, as prescribed by the Plaintiff. The Defendant jointly and severally guaranteed the Plaintiff’s credit card payment obligations to the Plaintiff and the balance of the overdue payment amount. The medical corporation of this case lost its interest by delinquency in the payment of the credit card use amount for 4 months as of February 25, 2020. Of the credit card payment overdue by the medical corporation of this case, 30,410, 29, 749, 162, and 1,69, 49, 162, and 15% of the annual interest on the overdue payment of the credit card payment, and 15% of the annual interest on the overdue payment of the credit card payment to the medical corporation of this case, or 214 through 45% of the annual interest rate as of the parties’ whole, and the purport of the pleading can be determined by the Plaintiff.
According to the above facts, the defendant, a joint and several surety of the medical corporation of this case, is obligated to pay to the plaintiff 36,867,625 won (i.e., 4,014,709 won in lump-sum payment, 30,410,299 won in lump-sum payment, 749, 162 won in late payment, 1,69,693,455 won in late payment, and 4,014,709 won in late payment from February 26, 2020 to the date of full payment, 15.5% in interest rate per annum in late payment, 30,410,29 won in late payment to the date of full payment, 15.5% in interest rate per annum in late payment, 21.9% in interest rate per annum from February 26, 2020 to the date of full payment.
Therefore, the plaintiff's claim against the defendant of this case is with merit, and it is decided as per Disposition by admitting it.
