The grounds of appeal are examined.
For the reasons indicated in its holding, the lower court acquitted Defendant 4 on the primary charges of violation of the Waste Management Act due to Defendant D’s failure to take measures against Defendant D and violation of the Waste Management Act due to Defendant F’s failure to take measures against Defendant F.
In light of the relevant legal principles and records, the lower court erred by misapprehending the legal doctrine on the person obligated to take measures under the Waste Management Act, as alleged in the grounds of appeal.
subsection (b) of this section.
In addition, the prosecutor filed an appeal against the Defendants as to the entire judgment of the court below, but the remaining parts of the appeal can not be found in the petition of appeal or the reasons for appeal.
Therefore, all appeals are dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
