Punishment of the crime
The defendant, as the representative of CF in B, is an employer who runs the original packaging processing business using 42 full-time workers.
1. When a worker dies or retires, the employer shall pay the wages, compensations, and other money or valuables within fourteen days after the cause for such payment occurred;
Provided, That the date may be extended by mutual agreement between the parties in extenuating circumstances.
Nevertheless, the defendant is working from May 7, 2012 to November 27, 2013 at the above workplace.
A retired D's 1,354,680 won of October 2013, 2013, wages of 1,042,940 won of November 2013, and labor from May 7, 2012 to November 27, 2013.
Retired E’s wages of 1,369,300 won on October 2013, and wages of 1,072,280 won on November 201, 2013, and labor from May 14, 2012 to November 27, 2013.
The retired FF's 1,339,400 won of wages on October 2013, and 1,110,050 won of wages on November 2013 (7,288,650 won in total for three workers, donesia, nationality: Donesia) was not paid within 14 days from the date of each retirement without any agreement between the parties on extension of the due date.
2. When a worker retires, the employer shall pay the retirement allowance within fourteen days after the cause for such payment occurred; and
Provided, That the date of payment may be extended by an agreement between the parties in extenuating circumstances.
Nevertheless, the defendant is working from May 7, 2012 to November 27, 2013 at the above workplace.
A retired D's retirement pay of 562,180 won, from May 7, 2012 to November 27, 2013
Retirement allowances of retired E shall be 603,060 won, and shall be employed from May 14, 2012 to November 27, 2013.
The retired F's retirement allowance of 680,910 won (a total of 1,846,150 won for three employees, Indonesia) was not paid within 14 days from each retirement date without agreement between the parties on extension of the due date.
