【Criminal Facts】

Defendant

A is a person who was the manager of the Seoul Yangcheon Branch of the Victim E corporation from August 25, 2008 to December 1, 2010, and Defendant B was the designer of the Seoul Yangcheon Branch of the said company.

The Defendants abused that the victim company paid solicitation fees, new settlement expenses, and customer management expenses in proportion to the number of insurance contracts and the scale of the paid-in insurance premiums kept by each insurance solicitor to individual insurance solicitors, and that the victim company would pay separate discount fees based on the number of insurance solicitors under its control and the number of insurance contracts kept by its affiliated insurance solicitors and the amount of the paid-in insurance premiums. They concluded an insurance contract under the name of the Defendants who do not intend to pay insurance premiums using the F's unique code, the insurance solicitor of the victim company that did not engage in almost little activities at the time, and attempted to deceiving the victim company by directly paying insurance premiums, and to obtain the commission paid to the Defendant A, the insurance solicitor, and the commission paid to the Defendant A.

Accordingly, around April 25, 2010, the Defendants concluded an insurance contract by lending the name of H with no intent to pay insurance premium using the above F’s unique code, and received two million won from the victim company as a solicitation allowance from around April 30, 2010 and received two million won from September 20, 2010 in total as shown in the separate crime list from around September 20, 2010.
