Defendant

A is a person who actually operates Co., Ltd. in Gangnam-gu Seoul, and Defendant B is a representative director in the name of the above company, and Defendants intended to pay KRW 300 million out of the capital amount of KRW 500 million necessary for the establishment of the above company by means of a balance certification and immediately repay it.

1. On February 11, 2019, the Defendants in violation of the Commercial Act committed an act of pretending the payment of capital by depositing KRW 300 million out of KRW 500 million to the Defendant’s name bank account and proving balance, and withdrawing all KRW 300 million from around 00:25 on the following day.

2. On February 12, 2019, the Defendants were in accordance with the above public offering, and around February 12, 2019, the Seoul Central District Court registered in Seocho-gu Seoul Central District Court, and a certified judicial scrivener, through a certified judicial scrivener, submitted relevant documents necessary for the registration of incorporation of a stock company, such as a balance certificate, to a registered public official who is aware of the fact that the capital was the most paid-in capital, and had the registered public official enter the false facts about the total amount of the capital of the said company in the commercial registry information system, electronic records identical to the authentic copy of the authentic deed, and exercised it by having the said public official
