2. The costs of appeal shall be borne by the Plaintiff.

Purport of claim and appeal

The first instance court.

A. On March 16, 2009, the Plaintiff was designated as a long-term care institution under the Act on Long-Term Care Insurance for Older Persons (hereinafter “the Elderly Insurance Act”), and operated until October 5, 2014, B providing beneficiaries under the Elderly Insurance Act, such as older persons, who are difficult to carry out daily life alone due to elderly or gender diseases, etc., with home care or home care benefits, such as visiting care, visiting bathing, etc., and the Defendant is an insurer of the long-term care insurance business under Article 7 of the Long-Term Care Insurance for Older Persons Act, and is a public corporation managing and operating the said business.

B. From November 18, 2013 to October 20 of the same month, the Defendant conducted an on-site investigation into the cost of long-term care benefits with regard to B operated by the Plaintiff from June 2013 to October 2013.

C. On January 6, 2014, based on the results of the above on-site investigation, the Defendant notified the Plaintiff of the aggregate of the cost of home visit care benefits, 3,618,20 won for home care benefits, and the cost of long-term care benefits, 200 won for beneficiaries C from June 2013 to October 2013, the sum of the cost of home care benefits, 200 won for home care benefits and the cost of long-term care benefits, 3,618,20 won for beneficiaries C and the cost of home care benefits from August 8, 2013 to September 13, 2013, the Plaintiff received the cost of long-term care benefits from the above beneficiaries (Notice of the Ministry of Health and Welfare No. 2012-162, hereinafter “instant Notice”).

The Plaintiff appealed against the instant disposition and filed an objection to the Defendant, but was dismissed on February 25, 2014, and the said decision on objection was rendered.
