1. Determination on admissibility of evidence

A. (1) The Constitution provides that any person who intends to guarantee the physical freedom as one of the fundamental rights shall not be arrested, detained, searched, or examined (Article 12(1)). A warrant issued by a judge upon the request of a prosecutor shall be presented in accordance with lawful procedures when arrested, detained, seized, or searched (Article 12(3) main text) is prescribed in the due process and the warrant requirement principle.
