마약류관리에관한법률위반(향정)
A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Punishment of the crime
The defendant is not a person handling narcotics as a ship of Chinese nationality.
1. On October 23, 2013, the Defendant received 800,000 won under the name of the purchase price of philopon, upon request from D to seek approximately one gram of psychotropic drugs-related Melopon (hereinafter “Melopon”) at C business places located in Yeongdeungpo-gu Seoul, Yeongdeungpo-gu, Seoul.
At around 01:00 on the following day, the Defendant received approximately one gram of philophone from D, and delivered it to D, to a person whose name is not known in front of the exit No. 12 located in Yeongdeungpo-gu Seoul, Yeongdeungpo-gu, Seoul.
Accordingly, the defendant assisted the purchase and sale of philophones by a person who is not aware of D and name.
2. On October 1, 2013, the Defendant received 800,000 won in the name of the purchase price of philopon at the above C business around 01:00,00, along with D’s request to seek approximately one gram of philopon from D.
At around 02:00 on the same day, the Defendant received approximately 1g of philophones from D, and delivered them to D, to a person who is unable to know his name in the street near the exit No. 12 located in Yeongdeungpo-gu Seoul Metropolitan Government E.
Accordingly, the defendant assisted the purchase and sale of philophones by a person who is not aware of D and name.
3. On October 2013, the Defendant received 800,000 won under the name of the purchase price of philopon, upon request from D to seek approximately one gram of philopon from D at the above C business around 22:00.
At around 23:00 on the same day, the Defendant received approximately 1g of philophones from D, and delivered them to D, to a person who is unable to know his name in the street near the exit No. 12 located in Yeongdeungpo-gu Seoul Metropolitan Government E.
Accordingly, the defendant assisted the purchase and sale of philophones by a person who is not aware of D and name.
4. On October 2013, the Defendant sought approximately one gram of philopon from D at the above C establishment around the lower order 22:00.
