[Judgment of the court below] The Jongno-gu Seoul Metropolitan Government E consists of five apartment buildings (101-105 Dong), two officetels (201-dong, 202 Dong), one commercial building (301 Dong), and one commercial complex (301 Dong).

Defendant

A is the chairperson of the council of occupants' representatives comprised of the apartment occupants of the above E, and the defendant B is the director of the management center of the above apartment.

On September 30, 201, the above council of occupants' representatives decided to prohibit residents from entering the second basement parking lot of vehicles visiting commercial buildings and vehicles visiting commercial buildings by amending the parking operation rules.

【Criminal Facts】

1. On October 6, 201, Defendant A instructed Defendant B to delete the parking information of residents in commercial buildings from a computer jointly used by the management body of commercial buildings and the council of occupants’ representatives. Accordingly, Defendant B deleted 364 items of parking information of residents in commercial buildings in the above computer parking management program on the same day.

As a result, the Defendants conspired to damage another person’s special media records such as electronic records.

2. On September 30, 201, Defendant A amended the rules on parking operation as above in order to prohibit the use of the second basement parking lot by the victim F and other shop visitors, and Defendant B prevented the entry of vehicles of shop residents into the parking lot from the first floor to the second floor above the parking lot by eliminating the parking information of the shop residents in the parking management program around October 6, 201.

As a result, the Defendants conspired to interfere with the parking of commercial residents, including victim F, by force.
