The defendant shall be innocent.
Reasons
1. A’s act of violating the restriction on vehicle operation on roads on November 16, 1993, around 15:17, to the employees of the defendant specified in the facts charged, on the roads front of the Msan Business Office 385.2 kilometers 385.2 kilometers in the intersection of the Southern Sea Highway;
2. Since the penal provisions applied to a summary order subject to review have retroactively lost effect according to the Constitutional Court’s decision of unconstitutionality, the Defendant is acquitted in accordance with the former part of Article 325 of the Criminal Procedure Act.
