1. The defendant,

A. As to the portion of 1/16 of the real estate listed in the separate sheet Nos. 1 through 8 to Plaintiff A and B, respectively.

Reasons

1. Facts of recognition;

A. “E” had eight children (including the Plaintiff and the Defendant, G, H, I, and J) between the wife F, but the F died on April 14, 2004, and E died on February 5, 2007.

B. E, prior to his birth, donated to the Defendant the real estate listed in the separate sheet Nos. 1 to 10 (hereinafter referred to as “instant No. 1 to 10 real estate”) in the order stated in the separate sheet, the ownership of which was owned, and the following registration was completed as to each of the instant real estate:

1) On August 18, 1989, the registration of transfer of ownership was completed on the ground of donation on August 17, 1989 with respect to the real estate Nos. 1 through 3 of this case on August 17, 1989. 2) On July 13, 1988, the registration of transfer of ownership was completed to the defendant on the ground of donation on July 5, 198.

3) On February 3, 1972, the registration of transfer of ownership was completed on the ground of sale on January 29, 1972 with respect to the real estate Nos. 7 through 10, and on July 12, 198, the registration of transfer of ownership was completed on the ground of sale on July 5, 198 with respect to the real estate Nos. 9 and 10, and on February 23, 2000, the registration of transfer of ownership was completed on January 10, 200 with respect to the real estate Nos. 9 and 10 on January 10, 200.

2. According to the facts of the judgment on the cause of the claim, the defendant is obligated to return to the plaintiffs 1/16 shares of each of the real estate of this case donated by E, which correspond to the ratio of the plaintiffs' legal reserve of inheritance. Since the shares of the real estate of this case Nos. 9 and 10 are impossible to return the original property, barring special circumstances.
