A. On September 24, 2014, the Defendant concluded a lease agreement with the Plaintiff’s spouse chain C as to the instant building; the lease deposit is KRW 50 million; the lease deposit is KRW 10 million on the date of the contract; the remainder of KRW 40 million on the date of the contract; and the lease period is to be paid on December 1, 2014; and the lease agreement was concluded between December 1, 2014 and November 30, 2016, respectively (hereinafter “instant lease agreement”).

B. As stipulated in the instant lease agreement, the Defendant paid KRW 50 million to C, and operated the “D Licensed Real Estate Agent Office” located in the instant building, and completed the registration of the brokerage office as of December 3, 2014.

(B) Around March 14, 2015, following the death of C, the Plaintiff on June 14, 2015: (a) the lease deposit and monthly rent are the same amount as that of the previous one; and (b) the lease deposit and monthly rent are to be deposited into the Plaintiff’s account other than C; and (c) the term of the contract was written from December 1, 2015 to December 1, 2016.

C. However, on October 30, 2015, the Defendant, without the Plaintiff’s consent, paid KRW 60 million to the Defendant as premium, and paid KRW 30 million to the Defendant at the time of the contract, and KRW 30 million as the remainder on November 29, 2015, and transferred the instant building including all facilities and business rights to remove all obstacles to the exercise of the right of lease on the instant building and to operate immediately upon the receipt of the remainder (Article 2), and the Defendant concluded a right transfer contract (hereinafter “instant right transfer contract”) with the Plaintiff based on the terms and conditions of the instant lease contract before the remainder payment date.

On the other hand, the defendant and E have the right to contain the above contents (facilities).
