1. The Defendant issued the Plaintiff the 3420 square meters receipt on November 28, 1973 with respect to real estate of 44,948 square meters in Chungcheongnam-gun, Chungcheongnamyang-gun, Chungcheongnam-do.
Reasons
1. On October 1, 1973, the plaintiff agreed with the defendant to establish superficies for the purpose of owning trees as to the real estate recorded in the order, and completed the registration of creation of superficies as to the above real estate on November 28, 1973.
However, as the above superficies has 30-year duration, the defendant is obligated to implement the procedure for cancellation registration of the above superficies creation.
2. Article 208 (3) 3 of the Civil Procedure Act applicable provisions of Acts.
