A Imprisonment of one year and six months, Defendant B’s fine of 5,00,000 won, Defendant C and D each fine of 1,50,000 won.
Punishment of the crime
1. From October 18, 2013 to February 26, 2014, Defendant A stolen approximately KRW 86,989,00 in total, KRW 57 times from Oct. 18, 2013 to Oct. 23:3:0, the following day, at the J night-si in Kimpo-si, approximately KRW 500 km, including five sn beam lines in the victim G, which are owned by Defendant G, into the cargo vehicle, and stolen it by means of loading it to the cargo vehicle in the way of loading it. As indicated in the attached list of crimes (1). < Amended by Presidential Decree No. 24274, Oct. 18, 2013 to Feb. 26, 2014>
Accordingly, the defendant habitually stolen another's property.
2. Around October 19, 2013, Defendant B purchased the volume of construction materials, such as five sn beam lines owned by the victim G, which he stolen from A from the above high water level around October 19, 2013, with the trade name of N in Kimpo-si.
In such cases, the defendant, who is engaged in the water-related business, has a duty of care to verify the personal information of A and describe the acquisition process of construction materials, such as the sn beamline, the motive for the sale, and the price suitable for the transaction price, and to confirm the stolen.
Nevertheless, the Defendant neglected such care and acquired stolen goods by purchasing 500 km, such as the H beamline, in 150,000 won per 1kg, from October 19, 2013 to February 19, 2014, as shown in the list of crimes (2), purchased construction materials, such as the H beam beamline, steel control pipe, etc. in total of 40 times from October 19, 2013 to February 19, 2014, and acquired stolen goods.
3. Around December 5, 2013, Defendant C purchased 500 km of construction materials, such as 6 sn beam lines owned by the victim G, which he stolen from A to A on the above high water surface, from around December 5, 2013.
In such cases, the defendant, who is engaged in the water-related business, shall verify and enter the personal information A, while the process of acquiring construction materials, such as the sn beamline, and the motive for selling them.
