On February 21, 2019, the Defendant was sentenced to one year of imprisonment and two years of suspended execution on March 1, 2019 by the Seoul Central District Court for a violation of the Act on the Control of Narcotics, Etc., and the judgment becomes final and conclusive on March 1, 2019 and is still under suspended execution.

Despite the fact that the Defendant is not a person handling narcotics, the Defendant dealt with the psychotropic drugs-related Mesofts (i.e., a single philopon; hereinafter “philopon”), as follows:

1. Upon receipt of B’s request from B, the Defendant: (a) sought the purchase price of a phiphone from B; (b) sought the phiphone in contact with the seller of the phiphone; and (c) decided to sell and purchase the phiphone in a way to cover the phiphone to B.

On April 21, 2018, the Defendant received KRW 500,000 from B in cash from B in the smoking room near the D parking lot located in Seocho-gu Seoul Metropolitan Government for the purchase price of phiphones, and delivered the price to the seller of philophones on his name, and thereafter delivered approximately 0.5g of philophones contained in a plastic bag from it to B, and sold KRW 1.5g of philophones to B three times from April 21, 2019 as indicated in the attached list of crimes.

Accordingly, the defendant, in collusion with the non-personal phone seller, sold a written phone to B.

2. On April 1, 2019, the Defendant: (a) sold approximately 0.5g of opopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopopop

3. At around 22:00 on April 1, 2019, the Defendant administered 0.1g of philophones received from B in the way of dilution into this beverage in the way of dilution in the way of the dwelling of the Defendant of Gwanak-gu, Seoul Special Metropolitan City E and F.
