The Defendant had already been found to have died before the instant lawsuit was filed and the order of correction to the effect that the Defendant and his heir submitted a family relation certificate within seven days from the date of service to the Plaintiff and the Plaintiff filed an application for correction of the party indication was served on July 30, 2015, but did not request the Plaintiff to correct the party indication with the lapse of the prescribed period.
Therefore, the lawsuit of this case is unlawful by a lawsuit filed against the deceased person, and the plaintiff cannot correct the defects without correcting them within the period prescribed by this court.
Therefore, the lawsuit of this case is dismissed by a judgment without holding any pleadings.
