The defendant is a person who operates a street in front of the branch office of corporate bank C in Dongdaemun-gu Seoul Metropolitan Government.

Any person who intends to build, rebuild, alter, or remove a structure, object, or other facility, or occupy and use a road due to other reasons shall obtain permission from the office of road management.

Nevertheless, the Defendant, without obtaining permission from the competent authority on July 7, 2016, installed a building and a gleep (pent roof tent) in front of Dongdaemun-gu Seoul, Dongdaemun-gu, Seoul, and operated a street store.

Accordingly, the defendant occupied and used a road without permission to occupy and use the road.
