The judgment below

In light of the records, the court below reversed the judgment of the court of first instance which found the defendant guilty on or around December 11, 2012 of the facts charged of this case to fall under the case where there is no proof of criminal facts, and found the defendant not guilty. Contrary to the allegations in the grounds of appeal, the court below did not err by violating the law of logic and experience and free evaluation of evidence.

On the other hand, the prosecutor appealed against the guilty portion of the judgment below, but the notice of appeal or the appellate brief does not indicate the grounds for objection to this part.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
