A defendant shall be punished by imprisonment for not less than eight months.
5,221,293,00 won shall be additionally collected from the defendant.
Punishment of the crime
Defendant was aware that he had been in common.
B With the proposal that gold bars will be paid in China from China to Korea or from Korea to Japan without filing an export declaration, the gold bars were sealed in China from China to Korea and the gold bars were sealed in Korea from Korea to Japan in a way of inserting 200g class balls in which metal detection is difficult.
1. The name, standard, quantity and price of the goods concerned, and other matters prescribed by Presidential Decree shall be reported to the head of the relevant customs office when he/she intends to export, import or return the sealed imported goods;
Nevertheless, the Defendant, at around August 15, 2015, entered the Incheon Airport using letter MaU549, China’s East-gu Air MaU549, and imported five gold bars at the market price of 49,695,000 won (a total of 1 kg) in the port text, and used the 60 times in total from around that time to May 15, 2016, and 39 times in total from around September 3, 2016 to around January 14, 2017, imported gold bars at the same price of 49,69,481,60,00 won in total by transporting the gold bars of the Defendant from around September 3, 2016 to around January 14, 2017.
Accordingly, the Defendant, in collusion with B, C, one-person D, etc., imported gold bars without filing a report thereon with the customs collector.
2. The name, standard, quantity and price of the goods concerned, and other matters prescribed by Presidential Decree shall be reported to the head of the relevant customs office when he/she intends to export, import or return the goods smuggling.
Nevertheless, on March 17, 2016, the Defendant left the Republic of Korea by taking advantage of the air KS001 letter for the Incheon Airport to the Do of Do in Japan, and concealed five 200g unit gold bars (a total of 1 kmg) of the market price of 52,470,000 won, which was requested by C to transport from the Incheon Airport, into the port, and pushed it into the port. It was from around that time to May 12, 2016.
