Defendant

A is a representative member of the management body of the above commercial building who has the authority to maintain and manage the "I" commercial building in Songpa-gu Seoul (hereinafter referred to as "the commercial building in this case") and select the service company for remuneration, and make a decision on the payment of progress payment, etc., and Defendant B and C are the employees of the company I (hereinafter referred to as "I") in charge of the management and repair of the above commercial building, the order for related services and the payment of progress payment.

The Defendants: (a) conspired to receive money and valuables from the J (hereinafter “J”) to receive the instant parking lot management and related services, etc.; and (b) around August 2013, Defendant C demanded money and valuables from K, which is the executive director of the J, and Defendant C thereafter, Defendant B received from K to deliver money and valuables in cash KRW 12 million to Defendant A at around that time.

As such, the Defendants conspired to accept KRW 12 million from July 2013, including accepting KRW 12 million in exchange for an unlawful solicitation in connection with the performance of duties by a person who administers another’s business.

9. Until the Middleman acquired 28 million won in total over four occasions, as shown in the annexed List of Offenses.

Defendant B, C, and C, along with L who was an employee of I, were provided with entertainment equivalent to KRW 1,500,000,00,00 with the illegal solicitation, such as Ma, N, etc., a staff member of J, at the early December 2, 2013, at the entertainment bar located in Gangnam-gu Seoul Metropolitan Government as a staff member of J, as set forth in paragraph (1).

As such, Defendant B and C conspired with L to obtain pecuniary benefits equivalent to KRW 1.5 million in return for an illegal solicitation in relation to the performance of their duties.
