The prosecution of this case is dismissed.
Reasons
1. The Defendant is a person who works as a street cleaners from B to B of the facts charged in this case.
On February 8, 2019, at around 22:00, the Defendant assaulted the victim E (the 44 years of age) on his/her face with his/her hand on the ground that he/she was drinking by drinking alcohol in Dongdaemun-gu (the 44 years of age).
2. Determination
(a) Applicable provisions of Acts: Article 260 (1) of the Criminal Act;
(b) Crimes of non-compliance with an intention (Article 260 (3) of the Criminal Act);
C. Indication of the victim as not to be punished after the prosecution of this case
