1. 상해 피고인은 2019. 12. 22. 01:00경에서 같은 날 03:00경 사이 전주시 덕진구 D빌라 E호에 있는 피고인의 주거지에서, B이 피해자에게 자신의 외도 관련 험담을 하였다는 이유로 B에게 “씨발년아, 더러운 년아, 냄새 나는 년아, 보지를 찢어 갈겨 죽여 버린다. 너 같이 더러운 년이랑 살아주는 것만도 감사하게 생각해라”고 욕설을 하면서 손으로 B의 머리채를 붙잡아 방안 벽에 5~6회가량 머리를 찧고, 양 주먹으로 B의 눈 등 얼굴 부위를 3~4회가량 때려 쓰러뜨리고, 오른손으로 쓰러진 B의 머리채를 붙잡아 방안을 끌고 다니며 양발로 B의 허리와 골반 부위를 3~4회가량 차는 등 폭행을 가하던 중 피해자가 바닥에 쓰러진 B의 몸 위로 껴안아 감싸 안으며 “왜 이렇게 사람을 때리느냐, 말로 해라”고 소리치자, 피해자에게 “씨발년아, 너도 똑같은 년이다, 너도 같이 죽어봐라, 니가 뭔데 끼어들어 말리고 난리냐”고 욕설을 하면서, 왼손으로 피해자의 머리채를 잡고서 오른손바닥으로 피해자의 왼쪽 뺨을 5회가량 때려 폭행하고, 이어 양발로 피해자의 가슴 부위를 10여 회가량 차 폭행하였다.
