피고인은 2014. 9. 2.경 불상지에서 리그오브레전드 온라인 게임에 닉네임 'B'로 접속한 뒤, 플레이어 5-10명이 볼 수 있는 게임 채팅창에 함께 게임을 하던 피해자 C(17 세)(닉네임 D)을 상대로 "애미가 뒤졌대요, 휘문고 다니는 ***있음, ㅋㅋ 애미뒤져서 가정교육 못받았다던데, 애미 뒤진 **야" 라는 글을 올려 공연히 피해자를 모욕하였다.

2. Determination

This is a crime falling under Article 311 of the Criminal Act and can be prosecuted only upon a victim’s complaint under Article 312(1) of the Criminal Act. According to the records, it is recognized that the victim submitted a written agreement to the effect that the victim does not want to punish the defendant to this court after the public prosecution of this case is instituted. Thus, the public prosecution of this case is dismissed in accordance with Article 32
