The prosecution of this case is dismissed.
1. The summary of the facts charged was around 04:00 on September 22, 2019, the Defendant asked the victim C (the age of 39) who is filing a civil suit against the Defendant in front of the Gwangjin-gu Seoul Special Metropolitan City to talk with a monetary issue, but refused this request. In this case, a male who is aware of the exact name of the Defendant and the victim were fighting each other with the victim, and assaulted the victim’s face once by walking over the floor.
2. Determination
(a) Crimes of non-compliance with an intention: Article 260 (3) and (1) of the Criminal Act;
B. After the prosecution of this case, the victim expressed his wish not to punish the defendant (see, e.g., written application for no punishment on October 14, 2019)
