A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Punishment of the crime
The defendant is a person who serves as an executive director in charge of business management, etc. in ( state)C that supplies franchising (test leasing) part of leading coal rink to ( state) B, a leading coal rink delivery company.
1. On April 20, 2009, the Defendant forged a public document and forged a copy of the test report in the name of the Administrator of the Small and Medium Business Administration in Busan, U.S., the number of “F”, “F”, “04, “11,” “14,” “600”, “60,” “555,” “55,” and “14,” “14,” “14,” and “600,” “55,” “5,” and “14,” the number of copies of the test report in the name of the Administrator of the Small and Medium Business Administration in Busan, Ulsan, and Ulsan, the number of samples held in advance, which are “SC16,” and “MC16, 209,” respectively. < Amended by Presidential Decree No. 20094, Apr. 14, 2009>
On April 27, 2009, the Defendant submitted a copy of the test report under the name of the Administrator of the Small and Medium Business Administration in Busan and Ulsan District Small and Medium Business Administration, which was forged to employees who are not aware of the forgery at the office of (StateB) G in Chungcheongnam-si, Chungcheongnam-si.
Accordingly, for the purpose of exercising authority, the defendant forged a test report (test number: E) in the name of the Administrator of the Small and Medium Business Administration in Busan and Ulsan District Office, which is an official document, and exercised it.
2. On April 27, 2009, the Defendant, at the (ju)B quality control department office, submitted the false name-based employees as if they were the document duly formed the test report under the name of the Administrator of the Small and Medium Business Administration of Busan and Ulsan District, which was forged, as prescribed in paragraph (1), to the said employees to deliver the franchise 25 feet manufactured in (ju)C)B and then received KRW 23,50,000 for the supply of the above franchise at around that time.
