1. The defendant shall pay 24,00,000 won to the plaintiff and 20% per annum from August 23, 2014 to the day of complete payment.
In full view of the purport of the argument in Gap evidence No. 1, as a whole, it can be acknowledged that Eul borrowed KRW 24 million from the plaintiff around 2008 and did not repay it. The defendant, which is the child of the above C, agreed to pay the plaintiff the above KRW 24 million borrowed by Eul to the plaintiff on behalf of December 30, 2010. Thus, the defendant is liable to pay the plaintiff damages for delay calculated at the rate of 20% per annum under the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings from August 23, 2014 to the date of full payment, which is the day following the day when the original copy of the instant payment order was delivered to the defendant as requested by the plaintiff.
Therefore, the plaintiff's claim of this case is reasonable, and it is decided as per Disposition by the assent of all participating Justices.
