Defendant

B is a corporation established on December 30, 2009 for the purpose of construction business, etc. in Jung-gu Seoul Special Metropolitan City E, and a business owner performing “F apartment construction project” in its own construction cost of KRW 128,265,90,000 from September 1, 2016 to January 19, 2019. Defendant A is a director of the construction site and a manager in charge of safety and health management of employees under his/her control and is a person who is responsible for the safety and health of employees under his/her control and is a corporation for B.

1. Defendant A

(a) A business owner shall install a safe passage to be used by his/her workers in a place or workplace and maintain it at all times;

Nevertheless, on October 19, 2017, the Defendant did not take necessary measures to prevent the danger at a place where workers might fall down, as the Defendant did not install a moving channel in the outer vision for the installation of a crypt in the said place of business.

(b) Business owners shall pay safety caps and wear them at the time of works in danger of falling or flying off objects, or of danger of falling by workers;

Nevertheless, on October 19, 2017, the Defendant did not take necessary measures to prevent the danger at a place where workers in the foregoing place of business failed to wear a safety cap, which is likely to fall by workers, or where material objects fall or are likely to fall.

(c)

The business owner shall install a strong structure with sufficient strength to take protective measures, such as safety rail, fence vertical fall-prevention net, etc., at a place where workers might fall down, as the end or opening of the work board and passage.

Nevertheless, on October 19, 2017, the Defendant did not install a safety rail at a single section of the 6-dong apartment construction section of concrete other construction work at the above place of business.
