A. From July 1968, G, H, I, J, K, K, L, M, N,O, P, Q, and R (hereinafter “the above persons”) were investigated into the crime of violating the National Security Act, etc. as the so-called “S case” along with G, H, I, K, K, K, L, M, N, P, Q, and R (hereinafter “the above persons”).

around July 30, 1968, the Deceased was investigated in a state of unlawful confinement without a detention warrant for seven days until August 5, 1968 when the custody warrant was issued and executed by an investigator of the Central Information Department.

G et al. also received investigations under illegal confinement without a warrant of detention for 53 days in a short period of two days after being conducted by the Central Information Department investigators;

(However, detention for H is not clear whether it is illegal confinement or not). G including the Deceased, etc. was harsh from the investigator of the Central Information Department in the course of the investigation.

B. The deceased, subject to a judgment, was indicted for violation of the National Security Act, violation of public law, and conspiracy of insurrection (Seoul District Court 68Da26652, 29827) through such unlawful investigation as above, and appealed for life on January 18, 1969, and the appellate court (Seoul High Court 69No133), reversed the judgment of May 27, 1969 and sentenced ten years of imprisonment and suspension of qualification to ten years (hereinafter “the judgment subject to a retrial”).

Although the deceased appealed against this, the Supreme Court (Supreme Court Decision 69Do1058) dismissed the appeal on September 23, 1969.

C. The Deceased’s Death was diagnosed on August 9, 1971 and was in a critical condition in the Daejeon Prison.

On September 29, 1971, the head of the Daejeon Prisons Office recommended the head of the Daejeon District Prosecutors' Office to suspend the execution of punishment, but the chief prosecutor of the Daejeon District Prosecutors' Office did not take any measures against this.

In the same day, the deceased performed the operation from the Do Medical Center at the Do Medical Center at the same time with an acute divestypitis caused by the said astronomical wave, and returned to the prison again on October 5, 1971, but sick.
