A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Punishment of the crime
"2018 Highest 2325"
1. Around June 13, 2018, the Defendant posted a false statement that “Acer Acer Acer Acler E-576-529cc (Not North Korea) access to the Internet E-site at the Defendant’s residence of the Defendant of the Seo-gu Northern Building D, Seo-gu, Seocheon-gu, Incheon-si, and sold money to the reported and contacted victim, and then, the Defendant sent money to the reported and contacted victim, he/she would deliver the said Not North Korea.
However, the Defendant did not have any intention or ability to sell the said North Korea even if he/she received money from the victim because he/she did not have the said North Korea.
The Defendant, by deceiving the victim as above, received 380,000 won from the victim to the account in the name of the Defendant in the name of G bank on the same day.
2. Around June 15, 2018, the Defendant, at the same place as above 1 and 2018, posted a notice stating that “The Defendant shall sell Ma34x (No. n.e., to the Chinese People)” with access to the said 1 site, and said false statement was made that the Defendant would deliver money to the victim with contact.
However, the Defendant did not have any intention or ability to sell the said North Korea even if he/she received money from the victim because he/she did not have the said North Korea.
As above, the Defendant, by deceiving the victim, received 200,000 won from the victim to the said G bank account as the price for sale in Nowon-gu.
No one shall intermediate a third party's communications through telecommunications services provided by a telecommunications business operator or provide such services for a third party's communications.
Nevertheless, on March 1, 2018, the Defendant received an I message from a nameless noble person (ID) who became aware of the Internet search and received 20,000 won per week on the face of the pre-paid, and designated the identity card, self-written pledge, and the Defendant’s photograph by using I message.
